Welcome to the SCI-WARE Blog. The Blog is controlled and administered by Science Warehouse Limited, ("SWL"), a company registered in England and Wales whose registered office is at Birmingham Road, Henley in Arden, West Midlands B95 5QA. Science Warehouse Limited's registration number is 02890957. The terms "us", "we" and "our" refer to Science Warehouse Limited. The term "You" refers to the user or viewer of the SCI-WARE Blog.

By using the SCI-WARE Blog You are agreeing to comply with and be bound by these Terms and Conditions of Use, which together with our Privacy Policy govern our relationship with You in relation to the SCI-WARE Blog. These Terms and Conditions may change from time to time without notice and it is Your responsibility to check for updates.

The use of this Blog is subject to the following Terms and Conditions:

1. Disclaimer:

1.1 We make no representations or warranties of any kind, express or implied, about the accuracy, reliability, completeness or suitability of the information and materials contained on the SCI-WARE Blog for any particular purpose. It shall be Your responsibility to ensure that any information available through the SCI-WARE Blog meets Your specific requirements. Any reliance You place on such information is therefore strictly at Your own risk and we expressly exclude liability for any inaccuracies, unreliability, incompleteness, unsuitability and consequences of use of such information to the fullest extent permitted by law.

1.2 You also understand that we cannot and do not guarantee or warrant that any material available for downloading from the SCI-WARE Blog or the website on which the SCI-WARE Blog is hosted will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy Your particular requirements for the accuracy of data input and output.

1.3 Notwithstanding any clause or statement to the contrary, we exclude any and all liability howsoever arising including but not limited to direct, indirect or consequential loss or damage arising out of or in connection with the use of the SCI-WARE Blog to the fullest extent permissible by law and in any event our entire liability under or in connection with these terms and conditions shall not exceed £50 during any 12 month period.  This exclusion of liability shall cover without limitation lost profits, data loss, business interruption, any indirect special or consequential loss or damages or economic loss.

1.4 Nothing in these terms shall exclude liability for fraudulent misrepresentation, death or personal injury caused by our negligence.

1.5 You agree to defend, indemnify and hold harmless SWL, its Directors, employees, agents, successors and assigns from and against any and all losses, costs, expenses, actions, claims or incurred as a result of any action, or threatened action, claims, demands or liabilities that SWL may suffer or incur or agree to pay in settlement of any claim, action, or threatened action, claim or demand, whether arising in tort or in contract in so far as the same arises directly or indirectly out of Your use of the SCI-WARE Blog or the performance of Your obligations under or Your breach or non-observance of these terms and conditions.

1.6 Through the SCI-WARE Blog You are able to link to other websites which are not under the control of SWL. We have no control over the nature, content and availability of those sites, and You agree that we have no liability in respect of them. The inclusion of a link does not necessarily imply a recommendation of an external website or endorse the views expressed within it.

1.7 Every effort is made to keep the SCI-WARE Blog up and running smoothly. However, You agree that we shall not be liable for the SCI-WARE Blog being unavailable for any length of time due to technical issues beyond our control. We make no warranty or representation of any kind that the SCI-WARE Blog is error free.

1.8 Contributions made to the SCI-WARE Blog by SWL staff reflect only the opinions of the individual contributor and do not necessarily represent the opinions of SWL.

2. Subscription to the SCI-WARE Blog

2.1 At present the Blog is free access. If in the future we provide a log-in facility then:-

2.1.1 As a SCI-WARE Blog subscriber You will receive access to the interactive section of the SCI-WARE Blog. You will need to be over 18 years of age to subscribe to the SCI-WARE Blog. We may refuse any application to become a SCI-WARE Blog subscriber for any reason whatsoever.

2.1.2 Your subscription to the SCI-WARE Blog will be for Your own personal use. You will not be permitted to share Your subscription with anyone. It will be Your responsibility to keep Your password private and secure.

2.2 We reserve the right to terminate or restrict Your use of the SCI-WARE Blog for any reason whatsoever without compensation and without notice.

2.3 We reserve the right without notice or explanation to delete or edit any comments submitted by users to the Blog. We would hope to have to do this only to eliminate spam, to remove offensive, profane, defamatory, abusive or otherwise inappropriate content and to correct spelling and grammatical errors, but our power to moderate the Blog is not limited to a need arising from one of these identified causes. Due to moderation, it is possible that there may be a delay between the submission of Your comment and Your comment appearing on the Blog.

2.4 You must not (a) republish material from this Blog (including republication on another website), (b) sell, rent or sub-license material from the Blog, (c) show any material from the Blog in public, (d) reproduce, duplicate, copy or otherwise exploit material on this Blog for a commercial purpose, (e) edit or otherwise modify any material on the Blog, (f) redistribute material from this Blog except for content specifically and expressly made available for redistribution (such as our newsletter).

2.5 You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this Blog without our express written consent. You must not use this Blog for any purposes related to marketing without our express written consent.

2.6 We reserve the right to restrict access to any areas of this Blog, or indeed our whole Blog, at our discretion.

3. Privacy Policy
3.1 Our Blog Privacy Policy sets out how we use and protect any information that You give us when You use the SCI-WARE Blog. Our Blog Privacy Policy is deemed to be incorporated into these Terms and Conditions and should be read together with them.

4. Intellectual Property
4.1 The SCI-WARE Blog contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than for Your personal and non-commercial use only. You may not, except with our express written permission, distribute or commercially exploit the content. Nor may You transmit it or store it in any other website or other form of electronic retrieval system.

4.2 All trademarks reproduced on the SCI-WARE Blog, which are not our property, or licensed to us, are acknowledged.
4.3 The SCI-WARE Blog lets You submit information to us. We do not claim any ownership right in respect of this information. However, by submitting information to us You grant us an irrevocable, perpetual, non-exclusive, royalty-free, transferrable and worldwide licence to use such information in accordance with our Blog Privacy Policy.

5. General
5.1 You agree that we may assign any or all of our rights and/or obligations under these Terms and Conditions to any third party.

5.2 You agree that Your rights and/or obligations under these Terms and Conditions are not transferrable and therefore cannot be sold, traded or subcontracted to any third party.

5.3 In no event do we accept liability of any description for the posting by You of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.

5.4 You must not misuse the SCI-WARE Blog by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.

5.5 You must not attempt to gain unauthorised access to the SCI-WARE Blog, the server on which the SCI-WARE Blog is stored, the server on which the SCI-WARE Blog is stored or any website, server, computer or database connected to the SCI-WARE Blog.

5.6 You must not attack the SCI-WARE Blog via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use the SCI-WARE Blog will cease immediately.

5.7 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of the SCI-WARE Blog or to Your downloading of any material posted on it, or on any website linked to it.

5.8 You may use the SCI-WARE Blog only for lawful purposes. You may not use the SCI-WARE Blog (a) in any way that breaches any applicable local, national or international law or regulation, (b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect, (c) for the purpose of harming or attempting to harm minors in any way, (d) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam), (e) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

5.9 Your contributions to the SCI-WARE Blog must not (a) be libellous or maliciously false, (b) be obscene or indecent, (c) infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right, (d) infringe any right of confidence, right of privacy, or right under data protection legislation, (e) constitute negligent advice or contain any negligent statement, (f) constitute an incitement to commit a crime, (g) be in contempt of any court, or in breach of any court order, (h) be in breach of racial or religious hatred or discrimination legislation, (i) be blasphemous, (j) be in breach of official secrets legislation, (k) be in breach of any contractual obligation owed to any person, (l) be pornographic [or sexually explicit], (m) be untrue, false, inaccurate or misleading, (n) consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage, (p) constitute spam, (q) be offensive, deceptive, threatening, abusive, harassing, or menacing, hateful, discriminatory or inflammatory.

5.10 A Contribution must (a) be accurate (where it states facts), (b) be genuinely held (where it states opinions). A Contribution must not (a) disclose the name, address, telephone, mobile or fax number, e-mail address or any other personal data in respect of any individual, (b) impersonate any person, or misrepresent Your identity or affiliation with any person, (c) give the impression that the Contribution emanates from SWL if this is not the case, (d) contain any advertising or promote any services or weblinks to other promotional sites.

5.11 These terms of use are for the benefit of You and us, and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and Your rights in relation to these terms of use is not subject to the consent of any third party.

5.12 This Agreement is the complete and entire agreement between the parties and supersedes any prior agreement, whether written or oral.

5.13 If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

5.14 Failure of either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

5.15 This Agreement, for all purposes, shall be governed by and construed in accordance with English law. You also agree, subject to the following clause, to submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under this Agreement.

5.16 If You wish to complain about any Contribution posted to the Blog, please e-mail SCI-WARE using the e-mail address (info@sci-ware.com). SWL will then review the Contribution and decide whether it complies with the Content Standards above. SWL will inform You of the outcome of its review within a reasonable time of receiving Your complaint."
